Research on the Circulation Management of Collectively-Owned Land for Construction Purposes in China: Comparison of Administrative Measures in Guangdong and Chengdu

ABSTRACT

The paper aims to comparatively analyze administrative measures for the circulation of collectively-owned land for construction purposes in Guangdong and Chengdu and dig deep into beneficial enlightenments for circulation management at the national level. Methods applied include comparative research, literature research, and theoretical research, with the principal findings: six aspects of common features and six aspects of unique features in the collective construction land administration in the two provinces (or cities). The conclusions are: (1) legislation practices of administrative measures in the two places has made a beneficial exploration and accumulated experience in legislation for the introduction of national-level collective construction land administrative measures; (2) in the future, the framework design of collective construction land administrative measures at the national level should adopt Guangdong measures largely, with Chengdu measures as the supplement; (3) property law, land management law, and other related legal provisions are suggested to be modified to crack existing legal constraints.
