Abstract
Ever since the Pilgrims set foot on these shores Americans have been concerned with riparian rights; The King of England had retained the right of navigation. In the past, tidal observations were the accepted method of determine the mean high water line (MHW). The National Ocean Survey and its predecessor, the U.S. Coast and Geodetic Survey, have issued publications and manuals on the subject for many years. The Borax Consolidated, Ltd. versus Los Angeles Supreme Court decision in 1935 became a landmark case. In 1975 things may have changed, at least in one state.
